f)     correspondence sent by the person that is implicitly or explicitly of a private or confidential nature or further correspondence that would reveal the contents of the original correspondence;

g)     the views or opinions of another individual about the person; and

h)    the name of the person if it appears with other personal information relating to the person or if the disclosure of the name itself would reveal information about the person.

Processing                                    Means any operation or activity or any set of operations, whether or not by automatic means, concerning personal information, including—

a)     the collection, receipt, recording, organisation, collation, storage, updating or modification, retrieval, alteration,
consultation or use;

b)     dissemination by means of transmission, distribution or making available in any other form; or

c)     merging, linking, as well as restriction, degradation, erasure or destruction of information.

POPIA                                            Means The Protection of Personal Information Act, which aims to protect personal information of natural and juristic persons.

Special Personal Information    It’s a subcategory of personal information that’s considered sensitive information. It’s information that can be used to unfairly discriminate against a person like race and ethnicity, health etc.

6.1. H Systems respects your privacy and takes the protection of personal information very seriously.


6.2. H Systems are committed to handling your personal information in the right way, for the right reasons and being fully compliant with the Protection of Personal Information Act and any related legislation.

6.3.1. Includes: Certain information collected on registration or while using our services Optional information that you voluntarily provide to us (see below).


6.3.2. Excludes: Information that has been made anonymous so that it does not identify a specific person; Permanently de-identified information that does not relate or cannot be traced back to you specifically; Non-personal statistical information collected and compiled by us and   information that you have provided voluntarily in an open, public environment or forum including (without limitation) any blog, chat room, community, classifieds or discussion board. Because the information has been disclosed in a public forum, it is no longer confidential and does not   constitute Personal Information subject to protection under this policy.

Any reliance you place on such information is therefore strictly at your own risk.

7.1.3.      In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this website.

7.1.4.      Through this website you are able to link to websites of our affiliations which are not under the control of H Systems (Pty) ltd, and the inclusion of any links does not imply an endorsement to the views expressed within such.

7.2.5.      Disclosure          Sharing              We may share your personal information with:  Other divisions or companies within the group of companies to which we belong so as to provide joint content and services like registration, for transactions and customer support, to help detect and prevent potentially illegal acts and violations of our policies, and to guide decisions about their products, services and communications;  Our service providers under contract who help with parts of our business operations (including fraud prevention, bill collection, technology services).       Our contracts dictate that these service providers only use your information in connection with the services they perform for us and not for their own benefit;  Credit Bureaux to report account information, as permitted by law;              Law enforcement.  We may disclose personal information if required:       by a subpoena or court order;       to comply with any law;       to protect the safety of any individual or the general public; and       to prevent violation of our service terms.              Marketing purposes.  We may disclose aggregate statistics (information about the customer population in general and anonymised terms) about the personal information.              Employees.  We may need to disclose personal information to our employees that require the personal information to do their jobs but they are all contractually bound to adhere to the provisions of POPI.              Change of ownership.  If we undergo a change in ownership, or a merger with, acquisition by, or sale of assets to, another entity, we will ask your permission to assign our rights to the personal information we process to a successor, purchaser, or separate entity. If you are concerned about your personal information migrating to a new owner, you can request us to delete your personal information.


7.2.6.      Security of personal information          Generally, we use continually updated computer safeguards such as firewalls and data encryption to protect personal information and we enforce physical access controls to our buildings and files. We authorise access to personal information only for those employees who require it to fulfil their job responsibilities.          Our hosting company will host our website in a POPI compliant environment and secure server environment that uses a firewall and other advanced security measures to prevent interference or access from outside intruders. We authorize access to personal information only for those employees who require it to fulfil their job responsibilities who have all contractually bound themselves to adhere to the principles of personal data protection.          We will not be held liable should your personal information be jeopardised, harvested, copied, amended or used as a result of fraudulent activity, an unwarranted or unforeseen infringement or breach of our firewalls.


7.2.7.      Accuracy          We will try to keep the personal information we collect as accurate, complete and up to date as is necessary for the purposes explicitly defined in this policy.         From time to time we may request you to update your personal information on the website or by other means. You are able to review or up date any personal information that we hold on you by contacting us. Please note that in order to better protect you and safeguard your personal information, we will verify your identity before granting you access to your account or making any corrections to your personal information. 


7.2.8.      Retention of personal information          We will only retain your personal information for as long as it is necessary to fulfil the purposes explicitly set out in this policy, unless:              retention of the record is required or authorised by law; or              you have consented to the retention of the record.  During the period of retention, we will continue to abide by our non-disclosure obligations and will not share or sell your personal information.


7.2.9.      Transfer of personal information outside South Africa          We may transmit or transfer personal information outside South Africa to a foreign country.        Personal information may be stored on servers located outside South Africa in a foreign country whose laws protecting personal information may not be as stringent as the laws in South Africa.          You consent to us processing your personal information in a foreign country whose laws regarding processing of personal information may be less stringent.


7.2.10.    Risk       By accessing this website, you understand that you are at risk and we will not be held liable for any occurrences whatsoever arising from this.


7.2.11.    Limitation       We are not responsible for, give no warranties, nor make any representations in respect of the privacy policies or practices of linked or any third party websites.

7.3.1.      Whilst we try to ensure that access to the Site is always available, from time to time. We may modify, suspend or discontinue, temporarily or permanently, the Site or any part of it, without notice. You acknowledge and accept that the Site or any part of it may not be available at all times.
